Grisbrook v MGN

Grisbrook v MGN: In proceedings brought by a freelance photographer, Mr. Grisbrook, against Mirror Group Newspapers, Patten LJ held on 16 October 2009 that it was an infringement of his copyrights for MGN to make an electronic archive of their published editions available to the public as a commercial venture. A human rights defence (among others) was put forward by MGN, but rejected on the basis that the existing fair user provisions, and the free availability of back numbers at, for example, the British Museum Library, was sufficient to satisfy the public interest. Alastair Wilson QC was acting for Mr. Grisbrook.
