MMI v Cellxion: On 20 October 2009 the Court of Appeal remitted to the trial judge certain prior use issues in a case involving infringement of a patent concerned with mobile phone tapping equipment and "IMSI catchers". New evidence had been delivered anonymously to the Defendants after the trial which the Court considered merited further consideration of the prior use issue. Alastair Wilson QC and Simon Malynicz were acting for the Defendants.
