Actavis v Novartis

The claimant sought to revoke the defendant’s patent relating to the use of a particular formulation of fluvostatin for the treatment of blood cholesterol.  Warren J held that the patent was obvious to the correctly constituted team of skilled addressees despite there being no motivation for producing that formulation.
