Boegli-Gravures v Darsail
The claimant owned a patent for a method of embossing foil for use in cigarette boxes. The claimant alleged that the defendants, the second of whom was the sole director of the first, infringed its patent by use of the method. Arnold J agreed that the patent was infringed and held that the second defendant was personally liable. The second defendant has dealt with the infringing acts personally, actions which went beyond merely exercising his constitutional role in the company.
