Edwards Lifesciences v Cook Biotech

The claimant sought to revoke the defendant’s patent relating to a stent valve.  An issue arose as to whether the patent had priority.  Kitchin J held that the defendant’s patent was not entitled to priority because the defendant had not had title to the invention from which priority was claimed when the patent application was filed.
