MMI Research v Cellxion

The claimant owned a patent concerning a method of identifying the user of a mobile phone and sued the defendants for infringement of the patent.  The defendants argued that the patent was invalid on various grounds including that the patent was anticipated by supply of the product to the Australian government.  Floyd J held that the disclosure had been confidential because the government had regarded it as such, although no explicit obligation had been imposed.
