Altecnic v Reliance
A trade mark application was made for valves in Class 7. The application ought to have been made in Class 11, as the valves were for plumbing goods. The Registry allowed the amendment, which was then opposed by Reliance which had applied to register the identical mark for valves in Class 11. The Court held that reference to the class number served to define goods which might otherwise fall into several classes, so that the amendment allowed had been in breach of section 39 of the 1994 Act.
