GMG Radio Holdings Limited v Tokyo Project Limited
One of the defendants had worked for the claimant in relation to its Hed Kandi music and nightclub business; he left and was setting up a new business with others. The artist who had produced most of the claimant’s artwork did the artwork for the new business. The claimant complained that the look and feel of the artwork for the new business amounted to a misrepresentation of a connection between the businesses and produced a video record of a survey designed to show confusion.
