LIFFE v Pinkava
This was the first time that the Court of Appeal had to consider ownership of inventions between employer and employees. Mr Pinkava had invented a number of ground-breaking inventions whereby exotic financial inventions such as Credit Index Swaps, Credit Default Swaps could be traded on an exchange by utilising the IT trading platform which was permitted to trade equities and futures.
The Court of Appeal considered the effect of s.39 Patents Act 1977 and its origins.
