P&S Platt Ltd v Crouch
A decision of the Court of Appeal which is of significance in its discussion of the extent to which pre-contract negotiations are admissible in determining what rights pass on a conveyance pursuant to section 62 of the Law if Property Act 1925. The Court of Appeal also considered accepted that a right to moor boats was a right capable of existing as an easement despite its adverse affect on the servient tenement.
