Profile

Becky was Hogarth’s 14th pupil. In December 2023, she was offered tenancy, and formally joined Hogarth in April 2024, upon completion of her pupillage.

Throughout her pupillage, Becky was supervised by Jonathan Moss, Jamie Muir Wood, and Gwilym Harbottle. She gained experience in confidential information (including acting as junior counsel for the respondent to an application for an interim injunction and amending an application to appeal a decision of the First Tier Tribunal), breach of contract (including advising on the likelihood of being successfully sued for inducement to breach of contract), copyright (drafting particulars of claim for a number of cases and attending a mediation on a large, international copyright case), trade marks and passing off (in the registry, the IPEC, and the High Court, and on appeal to the Appointed Person), patents (acting as junior counsel in the IPEC), and designs (working on a large, complex unregistered designs case involving contractual issues).

Career

Before coming to the Bar, Becky was a qualified Trade Mark Attorney and Trade Mark Attorney Litigator, with over seven years of experience. She worked as an Associate at Barker Brettell LLP on a range of different cases and for different clients, including several household names. She spent a large amount of time working on contentious matters, in particular opposition, invalidity, and revocation actions before the EU IPO. Becky also appeared before the Company Names Tribunal and ran successful online enforcement programmes involving suspending clone websites, domain name complaints, and taking down infringing content across social media platforms.

In addition, Becky spent time on secondment with the litigation and licensing team at Potter Clarkson LLP, where she worked on a number of patent matters, including TrailerLogic LLC v (1) Roftek Limited and (2) Simon Knowles Rothwell, for which she was later instructed as junior counsel.

Becky has a First Class degree in English Language and Literature from the University of Oxford and a distinction in the Graduate Diploma in Law.

Molavi v BBC – saw preparation of a respondent’s notice in response to an application for permission to appeal, against a summary judgment finding in relation to (no) copyright infringement.

Food Standards Agency v Transparency Data Limited – attended a case management conference for a claim for trade mark infringement and passing off and saw amended Particulars of Claim.

TVIS Ltd v Howserv Services Ltd & Ors (Re Trade Marks) [2023] EWHC 2589 (Ch) – attended the pre-trial review and trial for a claim for trade mark infringement and passing off.

Prysmian Cables & Systems Ltd v M/S Apple International & Ors [2023] EWHC 2176 (IPEC) – saw trial preparation for a claim for trade mark infringement and passing off.

Industria de Diseño Textil, S.A. (Inditex, S.A.) v Ffauf Italia S.p.A. – attended a case management conference for a rectification action in a trade mark invalidity dispute before the UK IPO.

WaterRower (UK) Ltd v Liking Ltd (T/A Topiom) – attended trial for copyright infringement, overlap between designs and copyright.

Hastings Fund Management (UK) Limited v Vantage Airport Group Limited – attended hearing before the Appointed Person in an appeal against a trade mark opposition decision.

LTWHP, LLC v Henkel AG & Co. KGAA – attended hearing before the Appointed Person in an appeal against a trade mark opposition decision.

Quadratech Diagnostics Limited v Check4Cancer Limited – attended hearing for consolidated trade mark opposition, invalidity, and revocation actions before the UK IPO.

Soho Group Co., Ltd v Havanna S.A. – attended trade mark opposition hearing before the UK IPO.

EasyGroup Limited v EasyFundraising Limited & Ors – attended costs and case management conference in a trial for trade mark infringement and passing off.

Instructed during pupillage in her own right, during her second six:

TrailerLogic LLC v (1) Roftek Limited and (2) Simon Knowles Rothwell – patent infringement and validity (novelty, inventive step, and sufficiency). Becky was instructed to appear as junior counsel on behalf of the Claimant, led by Richard Davis K.C.

Ontro Ltd v Delta Air Lines, Inc. O/1083/23 – trade marks, Brexit, estoppel, Henderson v Henderson, stays, and consolidated opposition and invalidity actions. Becky successfully appeared as sole counsel for Ontro against leading and junior counsel in this appeal before the Appointed Person.

Mr Selvarajah Jithenthrakumar v Mr Prasanna Sivanathan & Ors – Becky appeared in the county court on behalf of the Claimant (adjourned).

Bond Turner v (1) Patrick Maginn and (2) McDermott Smith Law Ltd – interim injunctions, imaging orders, breach of confidence. Becky was instructed as junior counsel in the Kings Bench Division at Manchester on behalf of the Second Defendant, led by Simon Malynicz K.C, and successfully resisted an application for interim relief, including an imaging order, in a claim for breach of confidence.

Ardutch BV v Ontel Products Corporation O/0067/24 – trade marks, oppositions. Becky successfully appeared as counsel for the respondent, Ontel, in this appeal before the Appointed Person.

Cloud Cycle Limited v (1) Verifi LLC and (2) GCP Applied Technologies (UK) Limited [2024] EWHC 233 (IPEC) – patent infringement, summary judgment, interim injunctions. Becky was instructed to appear as junior counsel on behalf of the Claimant, led by Richard Davis K.C.
