Re Force India Formula One Team Ltd [2022] EWHC 933 (Ch),
Jamie Muir Wood successfully argued that a term should be implied into a licensing and merchandising agreement that Force India would continue to operate an F1 team for the term of that agreement.
Having encountered financial difficulties, Force India had sold its team before the end of the term. This was found to amount to a breach of the implied term.
As a result, Jamie’s client, Stichd Sportmerchandising BV, has proven its entitlement to recover a debt in the subsequent creditors’ voluntary liquidation of Force India and now faces a quantum trial to quantify that debt.
